1. Purpose of Policy and collection of Personal Information:
Welcome to Reso website located at www.reso.co.in (the “Site”), providing for the Arbitration, Conciliation, and Mediation Services to Persons from all sections of society including Individuals, Hindu Undivided Families [HUFs], Association of Persons [AOPs], Body of individuals [BOIs], Firms, LLPs, Companies, Local authority, and any artificial juridical person. (“User/s,” or “Visitor/s” or “Person/s”). The Site provides one of the largest alternative dispute resolution platforms and is committed to respecting your privacy rights and complying with all applicable privacy legislation that may be enacted and amended from time to time.
The objective of this Privacy Policy, publicly available at the bottom of the home page of the Site, is to explain the process and practices regarding the collection and use of Personal Information of the Users by Reso no matter where they are located. “Personal information,” means any information relating to an identified or identifiable Person or User as defined above (such as name, address, telephone, email address, GPS information, biometric information, PAN number, and any other applicable registration number in case of non-individual users and so on just to give some examples), which alone or with other Personal Information can identify a Person/User/data subject. The policy will use “Personal Data,” “Personally Identifiable Information” and “Personal Information” interchangeably. The primary purpose of collecting Personal Information is to enable Users to avail of the various services offered by the Site. By accepting this Privacy Policy and related Terms of Use, the User/s consent to the collection, storage, use, share, and disclosure of his/their Personal Information as described in this Privacy Policy.
The Site is intended to collect and provide information from/to the Users about the various services offered by the Site and to facilitate the communication between/among the Arbitrators, Mediators, Counselors, Facilitators or other Dispute Resolution Professionals ( the “DRPs” ), associates, and employees of the Site in relation to such services.
2. What Information to be Collected and Basis for Collection:
The Site collects the following Personal Information provided by the Users for the purposes defined in clause 1 of this policy above.
A. Information required from General Visitors:
The Site encourages all sections of society to visit the same to understand the objectives of this Site and how the same can provide some useful services to them in a much more efficient and economic manner. For such general visits, the Site does not require any personal information.
B. Information required for availing of the Site services.
However, to use Services of the Site, the Visitors /Users shall create a profile by registering with the specific Service/s of the Site, by providing their name, email address, a visitor password, PAN no, and other dispute related information as may be applicable. By registering, the Users are authorizing the Site to collect, store, and use their Personal Information including the relevant documents provided as per this Privacy Policy. During the continuation of services, the Users may be required to submit any further Personal Information as may be required or asked by their concerned arbitrators, mediators, or other Dispute Resolution Professionals (DRPs) concerning their disputes.
3. How we use and share Information:
The Site and the related arbitrators, mediators, or other DRPs or any other concerned employee/associate may use the Personal Information provided by the Users to provide the various services listed on the Site and any other related communication among the aforesaid parties. However, under no circumstances, the Personal Information of the Users will be shared, sold, or otherwise transferred to a third party unrelated to the Users or their dispute/service matters without the prior authorization of the concerned Users. RESO shall make calls to the consumer despite the consumer being registered under Do not disturb (DND) service. These calls shall be made solely for service related communication, not for promotional/sales purposes. In addition, the Site may share the Personal Information of the Users under the following circumstances:
I. Protection of rights of Other Parties. The Site may use or share the Personal Information of Users if there are sufficient reasons to believe that:
(i) the access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order, or a request by law enforcement or governmental authorities,
(ii) such action is appropriate to enforce the Terms of Service for the Site, including any investigation of potential violations thereof,
(iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Services, or
(iv) such action is appropriate to protect the rights, property, or safety of the Site, its employees, DRPs, Users of the Services, or others.
II. Change of Ownership/Control: If the ownership/control of the Site is going to be changed either by sale, acquisition, merger or in any other manner, the Personal Information of the User may be shared or otherwise dealt with as per applicable laws prevailing at that point of time. However, the Users of the Site will be notified via a prominent notice on the Site before proceeding to such a change of ownership or control that would involve a transfer of their Personal Information held by us.
III. Service Providers. The Site may also engage some service providers such as data processors or other similar service providers which may require to use /access the Personal Information of Users in the discharge of their duties as per their engagement contract with the Site. However, they shall also abide to maintain the appropriate confidentiality and security measures, in strict compliance with this Privacy Policy.
IV. Marketing purposes. The Site may also occasionally use the Personal Information of Users for its marketing purposes, subject to applicable law. The Site may also send the emails, newsletters, articles of potential interest, announcements involving our DRP’s or new Services, and notice about bar association and legal events that may be of interest to Users unless they are specifically opt-out from receiving such communications.
V. Usage Data. The Site may share Usage Data and other aggregated, anonymized information that shows patterns, trends, preferences, and other collective characteristics of the Users, with third parties to evaluate and improve its communications, advertisements, services, and general business practices to the needs of the Users.
VI. Public Authorities. The Site may disclose the Personal Information of the Users in response to lawful requests by public authorities, including to meet national security or enforcement requirements.
4. Rectification, and Erasure of User Information;
I. Right to Rectification: Users may request to rectify or complete their Personal Information if the same is required, subject to providing the documentary proof of correct information and the reasons for providing the wrong or incomplete information in the first place. The Site reserves its right to accept or reject such requests and/or ask any further documents and information in the overall interest of all the related parties to be satisfied that the purpose or intention for asking the change is not prejudicial to the interest of any other related party. For this purpose, a written request may be forwarded by the Users to the Site with all the required documentary proofs and reasons as aforesaid in this clause and the same will be responded within 30 working days.
II. Right to Erasure: The Site may continue to maintain the Personal Information of the Users and the details of services provided by the Site including the details of Awards/Mediation/Conciliation/any other Facilitation Issued/Provided by the Arbitrators and other DRPs for future record and reference as per applicable laws prevailing from time to time. Later on, after the expiry of the maximum record retention period prescribed under the law, the Site will erase the Personal Information of Users.
5. Third-PartyWebsites
While using the Site and certain Services, the Users you may have the access to or link to third-party websites, e.g., they may be referred to a payment processor website to provide credit card information or to a case management Site to facilitate such services. Linked third-party websites are independent of this Site, and may have their separate terms of use/service and privacy policies, which govern your use of such websites. This Site does not any way endorse or otherwise responsible for the conduct of such third-party websites.
6. Security:
The Personal Information provided by the Users is stored on servers located in secure third-party data centers with restricted access, and the same is protected by protocols, procedures, and best practices designed to ensure the security of such information. Besides, we restrict access to Personal Information to our employees, independent contractors, and agents who need to know this information to develop, operate, and maintain the Services, and are subject to high confidentiality obligations. Since, no server, computer or communications network or system, or data transmission over the Internet, can be guaranteed to be 100% secure and they may subject to some third-party security risk which may happen at some point in time. In case of any such event, the Site will notify the Users immediately as per the law prevailing at that point in time.
7. Minor/Children’s Privacy:
As per Indian Contract Act, 1872, any contract with a Minor is Voidable at his option. Therefore, as a general rule this Site is not intended to collect any personal information of a Minor (i.e. a person of under 18 years of age), unless the same is required to be collected under the specific circumstances relating to a particular user a particular service of this Site. In that case also, the personal information of a Minor shall be collected with the prior consent of his legal guardian as per the applicable laws prevailing at that point of time.
8. Notification of Changes
This Privacy Policy may change from time to time and the Site will post all the most current, updated Policy here. Users are suggested to review the same periodically to ensure that they agree with the latest updates.
